Choosing the Right Estate Planning Attorney

Estate planning is the process of preparing documents to assist your family with end-of-life decisions and the distribution of your assets after death. Nikki Allen is a Palm Desert estate planning attorney practicing law for over 20 years. Her extensive experience creating comprehensive estate plans will protect your chosen beneficiaries according to your intentions.

Property owned by your family can often be your children’s financial future. You need to find a firm with a vast knowledge of the law that understands their clients rely on them for more than just property and money. If you are unable to take care of your family, you must ensure they will have the money to maintain their quality of life. The documents your estate planning lawyer meticulously prepares will determine your children’s future upon your death.

Protect Your Children and Your Legacy

Life is uncertain, and safeguarding your loved ones is your most important investment. In California, the definition of family extends to all those you love, whether they are your spouse, children, pets, or dear friends. Ensuring your family’s future, however you define it, is vital.

Ensuring Your Wishes Are Fulfilled

Having an estate plan is one of the most thoughtful decisions you can make for the people you love and care about. You must meticulously plan and document how managing your funds and assets is to be handled to align with your precise wishes. You can nominate the person you most want to be a guardian for your minor children or pets. Without creating an estate plan, your wealth will be subject to intestate succession upon your death, exposing your assets to probate, and California law will dictate the beneficiaries.

The Estate Planning Process

The estate planning begins with a consultation to discuss your estate planning needs and goals. The composition of your family and minor children will directly impact the appropriate strategy. Our estate planning lawyer will work with you to create a personalized estate plan that meets your unique needs and lifestyle. Options may include the creation of a will, trust, and powers of attorney. We will also help you understand the probate process and how to avoid it.

If you already have an estate plan, rest assured that we will ensure it matches your current needs and desires.  We will make any necessary amendments to your estate planning documents to provide you with the most protection based on changing laws and your changing life circumstances, offering you ongoing support and reassurance.

My Business is to Protect Your Children

In my California law practice, a Revocable Living Trust is the most common vehicle used for transferring assets and providing for the care of minor or disabled beneficiaries. A Revocable Trust is an instrument to hold legal title to most of your assets and will determine the management of these assets. During your lifetime you (and your spouse or another person of your choosing as co-trustee) are the trustee and beneficiary of the living trust.  Should you choose to change the Trust, you can freely do so at any time while you (and your spouse or co-trustee) are still living. The Trust allows you to dictate the final disposition of your assets and nominate a successor trustee to manage your entire estate.  The benefit of having trust instead of a will is that it allows your heirs to avoid probate court which usually takes about a year and requires fees to be paid out of your estate pursuant to statute.

Palm Desert Law Practice

Nikki Allen personally drafts Revocable Trusts, Wills (including Pour-Over Wills), Durable Powers of Attorney and Advanced Health Care Directives.  Ms. Allen will not turn your documents over to her team of legal assistants or paralegals.  She runs her business to effectively protect the property and assets of California families. Ms. Allen also prepares Special Needs Trusts for beneficiaries of a settlement or trust who need to preserve their rights to receive governmental assistance and benefits for their disability.

Durable Power of Attorney

A Durable Power of Attorney is a document that enables you to nominate an individual to act on your behalf in the event of your incapacity.  The individual, called an Agent, can manage your finances when you cannot do so yourself. If you become incapacitated, there may be a court case to appoint a conservator to manage your affairs. You will not have the power to choose the person who manages your affairs, and you must pay a conservator to manage them. The time-consuming and emotional toll this will put on your family will come at the worst possible time in your life.
